1. Introduction

These Terms and Conditions govern the relationship between Montana Peru Travel Agency (“Montana Peru”, “we”, “our”, or “us”) and the client (“you” or “traveler”) regarding the purchase and use of travel services offered by our agency.

By booking or using our services, you agree to these Terms and Conditions.

2. Booking and Confirmation

A reservation is considered confirmed once:

  • The client completes the booking process, and

  • The required deposit or full payment has been received by Montana Peru.

After confirmation, the client will receive a booking confirmation by email containing the details of the reserved services.

Montana Peru reserves the right to decline any booking at its discretion.

3. Payments

Payments for services may be made through the payment methods authorized by Montana Peru.

Payment conditions may include:

  • Deposit: A percentage of the total price required to confirm the reservation.

  • Final Payment: The remaining balance must be paid before the travel date as specified during the booking process.

Failure to complete the required payments may result in cancellation of the reservation.

4. Prices

All prices are subject to change without prior notice until a reservation has been confirmed.

Prices generally include only the services specified in the itinerary and may exclude:

  • International flights

  • Travel insurance

  • Personal expenses

  • Meals not specified

  • Optional activities

All applicable taxes or service fees will be indicated when applicable.

5. Cancellations and Refunds

Cancellation requests must be submitted in writing via email.

Refund eligibility depends on the time of cancellation and supplier policies. In general:

  • Administrative fees may apply.

  • Some services (such as entrance tickets, train tickets, or flights) may be non-refundable.

Montana Peru will inform the client of the applicable refund conditions at the time of booking.

6. Changes to Bookings

If the client wishes to modify a reservation, Montana Peru will make reasonable efforts to accommodate the request.

However:

  • Changes are subject to availability.

  • Additional costs may apply depending on suppliers and service providers.

7. Client Responsibilities

The client is responsible for:

  • Providing accurate personal information required for bookings.

  • Holding a valid passport and necessary travel documentation.

  • Complying with visa, health, and entry requirements for Peru.

Montana Peru is not responsible for issues resulting from incomplete or incorrect documentation.

8. Travel Insurance

Montana Peru strongly recommends that all travelers purchase comprehensive travel insurance, including coverage for:

  • Trip cancellations

  • Medical emergencies

  • Personal accidents

  • Loss of luggage

Montana Peru is not responsible for costs incurred due to lack of insurance coverage.

9. Limitation of Liability

Montana Peru acts as an intermediary between clients and independent service providers such as hotels, airlines, transportation companies, and tour operators.

Therefore, Montana Peru shall not be held liable for:

  • Delays, cancellations, or changes made by service providers

  • Natural disasters, weather conditions, or force majeure events

  • Accidents, injuries, loss, or damage occurring during the trip

10. Changes to Itineraries

Montana Peru reserves the right to modify itineraries when necessary due to:

  • Weather conditions

  • Safety considerations

  • Operational requirements

  • Circumstances beyond our control

In such cases, we will offer reasonable alternatives whenever possible.

11. Force Majeure

Montana Peru shall not be responsible for failure to perform its obligations if such failure results from events beyond its control, including but not limited to:

  • Natural disasters

  • Political unrest

  • Pandemics

  • Government restrictions

  • Strikes or transportation disruptions

12. Privacy and Data Protection

All personal information collected during the booking process will be handled in accordance with our Personal Data Protection Policy.

13. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Peru.

Any disputes arising from these terms will be subject to the jurisdiction of the competent courts in Peru.
